Respected Sir,
1. I belong to Indian Telecom Service, a Group-A Central Civil Service of the
Government of
Pay and allowances are governed by the prevailing Central Civil Services Pay
Rules of Government of India as applicable to any other Services of the Central
Civil Service Group-A.
2. Recently the Government of India notified the Central Civil Services
(Revised Pay) Rules 2008 and revised the pay scales of the Central Government
employees vide references cited above with effect from 01-01-2006. As on
01-01-2006, I was in Non-Functional Selection Grade (NFSG) with the basic pay as
Rs .15,500 in the pre-revised scale (S24) of 14300-400-18300.
3. Though the pay scales in the cadre of the Central Services have been placed
in similar pay scales as that of Indian Administrative Service, the IAS cadre
has been given an edge in pay scales over the other All India Services and
Central Services in the grades Senior Time Scale (STS), Junior Administrative
Grade (JAG) and Non-Functional Selection Grade (NFSG), traditionally from the
time of the First CPC onwards.
4. A perusal of the Fifth CPC pay scales reveals that the edge for IAS in STS,
JAG and NFSG pay scales is equal to two additional increments. Accordingly, by
the Fifth CPC, the NFSG officers of IAS were placed in 15100-400-18300 (S25) pay
scale, while the NFSG officers of other Central Services were placed in
14300-400-18300 (S24) pay scale.
5. The Sixth CPC also recommended the retention of the existing edge for IAS
in STS, JAG and NFSG, which was accepted by the Government. But in
of the Sixth CPC Report, it was reiterated "It has also been ensured that a
person drawing higher basic pay in any Fifth CPC pay scale is not fitted lower,
vis-vis a person drawing lower basic pay irrespective of the pay scale."
6. In the wake of the above, it is only logical that all officers with the
same basic pay of Rs.15100 as on 01-01-2006, belonging to different services
vis-vis IAS or other Central Services, either in the pay scale S24 or in S25,
need to be fixed in the same basic as on 01-01-2006 in the revised scales, since
the advantage of two increments for IAS has already been given in the start of
the pay scale.
7. However, in the Fitment Tables given in the Annex-I of the
reference -3 cited above, the basic pay of Rs.15100 in the old pay scale S25 is
fixed at Rs 39,690/-, while the same basic pay in the old pay scale S24 is
fixed at Rs 38,530/-. But while fixing the basic pay in the Sixth CPC pay
scales, for the Officers belong to IAS and other Central Services in STS having
S19 & S20pay scales and in JAG having S21 & S22 pay scales, such an anomaly does
not exist.
8. This is a clear anomaly as my basic pay which was Rs.15500 as on 01-01-2006
(in S24), was fixed as per the Fitment Tables given in the Annex-I of the
vide reference -3 cited above, at Rs. 38,530/- as on 01-01-2006 in revised
scale, whereas an officer with same basic in S25 is being fixed at Rs 39,690/-.
This is against the spirit of the accepted recommendation of the Sixth CPC
Report, as I am drawing now lesser pay than an officer drawing lesser pay than
me in the pre-revised scale.
I, therefore, humbly request you to kindly initiate action for correcting this
anomaly and refix my basic pay in the revised Sixth CPC pay scales, in such a
manner that the revised basic pay corresponding to the pre-revised basic pay in
the pay scales S-24 and S-25 are common after the basic pay of Rs.15100 in the
pre-revised scale.
